Establishing legitimate software licensing of your machines during an inspection by the authorities.
In the case of a software audit by the respective authorities in your country, the inspecting party will typically use a device with a USB interface that displays all licensed software installed on the machine, together with the respective licence keys.
Once it is established which software licences are in use on the machine, a document evidencing the purchase of those licence keys (an invoice) is required. When all documentation relating to the purchase of the installed software is presented, the machine is deemed to be legally licensed.
Most obviously, businesses run the risk of being fined for using unauthorised software — but they also expose themselves to security threats in the form of malware and cyber-attacks in general.
Most pirated products are old and incomplete versions, some of which carry destructive viruses that can delete or damage files. They may also contain “spyware”, through which cybercriminals can access and use confidential information such as bank accounts and personal data. In addition, with illegal software a business cannot take full advantage of the product and is not entitled to support or updates. Once a software licence is purchased legitimately, the legal software vendor provides updates that protect your computers and systems from ever-evolving threats — usually free of charge.
Refurbished (pre-owned) licences have been released on the market but were never previously activated, and have been returned to the secondary market for resale. They are fully functional and come with 100% legal and technical guarantees.
Our inspection process follows strict procedures and we work only with verified suppliers. Licences obtained in this way are eligible for resale because of their certifiable origin. The resale of software is protected within the EU by a 2012 ruling of the Court of Justice of the European Union:
“An author of software cannot oppose the resale of his ‘used’ licences allowing the use of his programs downloaded from the internet. The exclusive right of distribution of a copy of a computer program covered by such a licence is exhausted on its first sale.”
You can read the full ruling (UsedSoft GmbH v Oracle International Corp., Case C-128/11) here. This established that the resale of such software licences is fully legal, allowing individuals and companies to take advantage of the lower prices of these licences while remaining fully licensed.
